1. Who we are and what BudnBed is1.1 These Terms govern the use of BudnBed (budnbed.com, app.budnbed.com, the "Platform"), operated by BudnBed Technologies, operated by Mandeep Kumar, Fanningerstraße 45, 10365 Berlin, Germany ("BudnBed", "we"). Contact: hello@budnbed.com.
1.2 BudnBed is an online marketplace where verified students book residential accommodation. Hosts may be private individuals, students subletting, live-in hosts, residences, co-living operators or hostels.
1.3 BudnBed is an intermediary only. We are not a party to any agreement between users, not a landlord, not a property manager, and not a real-estate broker. The rental or sublease agreement is concluded exclusively between the host and the guest. Sample contract templates we provide are non-binding information, not legal advice.
2. Eligibility and accounts2.1 The Platform is available only to persons aged 18 or over. Guests must be enrolled students (or admitted incoming students) at a recognized higher-education institution. Hosts may be private individuals or businesses.
2.2 One account per person. Account credentials are personal and non-transferable.
2.3 Booking, listing, and messaging require completed verification (Section 3). Guests must complete identity and student-status verification. Hosts must complete identity verification, and business hosts must additionally verify their business.
3. Verification3.1 Before hosting or booking, users must complete verification by submitting a government-issued ID. Guests additionally submit proof of student status. Business hosts additionally submit company registration details. Processing is described in our Privacy Policy and requires the user's explicit consent, given before upload.
3.2 Verification documents are reviewed and deleted within 48 hours of the verification decision. Only the verification result is retained.
3.3 Verification confirms identity, and for guests student status, only. It is not a guarantee of any user's conduct, solvency, or the accuracy of their listings.
4. Listings and host warranties4.1 Hosts must describe their accommodation truthfully and completely, including whether sleeping arrangements are private or shared, using current photos and videos of the actual premises. Listings state, as declared by the host, which features are provided, for example whether city registration (Anmeldung) is possible, whether a written agreement is offered, and what is included. BudnBed displays these declarations as provided by the host and does not verify or guarantee them.
4.2 By publishing a listing, the host warrants that: (a) they hold all permissions required to let the accommodation, including, where the host is a tenant subletting, the landlord's permission under §§ 540, 553 BGB; (b) the offer complies with applicable housing law, including the Berlin Zweckentfremdungsverbot-Gesetz where applicable; (c) they will conclude a written rental or sublease agreement with the guest.
4.3 The host bears sole responsibility for the consequences of missing permissions or non-compliant offers. BudnBed may request evidence of permissions and may suspend or remove listings upon complaints or reasonable doubt.
4.4 Rental or sublease agreement: The host must provide the guest with the written agreement upon booking confirmation and at the latest by move-in. BudnBed provides a sample template for convenience; its use is recommended but the content of the agreement is solely the parties' responsibility.
5. Permitted stay durations5.1 The applicable stay rules depend on the type of accommodation listed.
5.2 Private residential listings (including rooms and flats let by private landlords, tenants subletting, and live-in hosts): the minimum bookable stay is 14 days and the maximum is 12 months. Stays of less than 30 days are limited to two (2) bookings per listing and per host within any calendar year. The Platform enforces these limits technically. These limits exist to keep short stays within the scope of lawful occasional residential letting, in particular under the Berlin Zweckentfremdungsverbot-Gesetz.
5.3 Commercially licensed accommodation (including hostels, student residences, co-living operators and other providers operating under a commercial accommodation permission or an applicable exemption): no minimum stay applies. By listing under this category, the host warrants that it holds the permissions required to offer short-term accommodation and that its offer complies with applicable law. BudnBed may request evidence of these permissions.5.4 Hosts must select the correct listing type. Selecting a commercial category without holding the required permissions is a material breach of these Terms.5.5 Circumventing duration or frequency limits (including via multiple accounts, off-platform arrangements initiated on the Platform, misdescribed dates, or misdeclared listing type) is prohibited and may lead to suspension or termination.
6. Booking, fees, and payments6.1 Bookings are concluded on the Platform: the guest sends a booking request; the host accepts; upon acceptance and payment of the service fee, a binding booking arises between host and guest.
6.2 Payment processing is provided by Stripe. BudnBed does not itself hold user funds. Hosts complete Stripe's payout onboarding (including identity verification by Stripe) and provide their tax identification number (Steuer-ID), or, for business hosts, their company registration details and tax identification as required by the Plattformen-Steuertransparenzgesetz.
6.3 Fees: Hosts pay no fee. Guests pay a one-time service fee of 8% of the first month's rent, minimum €25, charged at booking. All payment-processing costs are included in the service fee. BudnBed charges fees only on the first month's rent; no fees apply to subsequent months or deposits.
6.4 Payment flow: Listings can be booked no earlier than 60 days before move-in. Upon the host's acceptance, the guest has 24 hours to complete payment; otherwise the booking request expires. Payment of the first month's rent (and any service fee) is made in full at booking. Funds are held by our payment partner Stripe and released per Section 6.5.
6.5 Release of funds to the host: The first month's rent is held and released to the host (a) as soon as the guest confirms successful move-in via the Platform or by email to hello@budnbed.com, or (b) automatically 48 hours after the agreed move-in time if no dispute has been reported under Section 8, whichever occurs first.
6.6 Subsequent months: Rent for months two and onward is paid directly between guest and host as agreed in their sublease agreement. BudnBed is not involved in, and assumes no responsibility for, these payments.
6.7 Deposits: Hosts may state a security deposit (Kaution) amount in their listing. This information is displayed for transparency only. The deposit is agreed, paid, held, and returned directly between host and guest in accordance with their sublease agreement and applicable law; it is never charged, held, or processed through the Platform, and no BudnBed fees apply to it. BudnBed does not verify deposit amounts and assumes no responsibility for the payment, safekeeping, or return of deposits.6.8 Partner listings. Certain operators, including student residences and co-living providers, manage bookings and payments in their own systems. These listings are marked "Partner listing" on the Platform. For partner listings: (a) the guest sends a booking request on the Platform, which the operator accepts or declines; (b) on acceptance, BudnBed shares the guest's full name and email address with the operator so that it can complete the booking, and no personal data is shared for declined requests; (c) the booking and the tenancy agreement are concluded directly between the guest and the operator, on the operator's own system; (d) all payments are made directly to the operator, and BudnBed does not receive, hold or process any payment for partner listings; (e) the operator's own booking, cancellation and refund terms apply; (f) Sections 6.1 to 6.5, 7 and 8 do not apply to partner listings.
7. Cancellation policy7.1 By the guest: a) Within 24 hours of booking confirmation, the guest may cancel and receive a full refund minus payment processing costs. This does not apply where move-in is less than 14 days after booking confirmation; in that case, the booking is binding from confirmation.b) After this window, no refund is made, unless the host agrees to the cancellation. If the host agrees, the rent is refunded to the guest minus payment processing costs, and the listing may be republished.c) No-show: no refund.d) The dispute process in Section 8 remains unaffected.
7.2 By the host: the guest receives a full refund of all amounts paid, minus payment processing costs. The guest's next service fee is waived. Repeated host cancellations lead to reduced visibility, suspension, or account termination.
7.3 Any service fee, where charged, is non-refundable except in cases under 7.2. Statutory rights, including the rules described in our Withdrawal Notice, remain unaffected.
8. Dispute process (move-in protection)8.1 If the accommodation materially deviates from the listing (materially different premises, uninhabitable condition, no access, wrong location), the guest must report this via the Platform or to hello@budnbed.com within 48 hours of the agreed move-in time, with photo or video evidence.
8.2 A timely report suspends the payout to the host. BudnBed reviews both parties' evidence and decides within 5 business days: full refund, partial refund, or release to the host.
8.3 Not covered: subjective dissatisfaction, minor deviations, or change of mind.
8.4 BudnBed's decision is final for the handling of the held amount on the Platform. The parties' statutory rights against each other remain unaffected.
9. Communication, reviews, conduct9.1 The Platform chat opens after a host accepts a guest's request. Users may not use the Platform to initiate off-platform bookings for stays arranged through the Platform.
9.2 After a completed stay, both parties may leave a review. Reviews must be truthful and relate to an actual stay. BudnBed may remove unlawful reviews.
9.3 Prohibited: unlawful listings; discrimination or harassment; surveillance devices in private areas; fraud or misrepresentation; use of the Platform by non-students as guests, or for non-residential purposes.
9.4 Notice-and-action: Illegal content or conduct can be reported to hello@budnbed.com. We review reports promptly and remove or block unlawful content. Contact point pursuant to the Digital Services Act: hello@budnbed.com.
10. Content licence10.1 Users retain all rights to their photos, videos, and texts. Users grant BudnBed the non-exclusive licence to host and display this content on the Platform for the operation of the service only. BudnBed does not use user content for advertising or marketing without separate, explicit consent obtained for the specific case.
11. Liability11.1 BudnBed is liable without limitation for intent and gross negligence, and for injury to life, body, or health.
11.2 For simple negligence, BudnBed is liable only for breach of essential contractual obligations (Kardinalpflichten), limited to the foreseeable, contract-typical damage.
11.3 BudnBed is not liable for the conduct of users, the accuracy of listings, the existence of hosts' permissions, the content or performance of rental or sublease agreements between users, payments made outside the Platform, or deposits.
12. Term, termination, changes12.1 Users may delete their account at any time. Booking and invoice records are retained as required by law (10 years, § 147 AO, § 257 HGB) in minimized form.
12.2 BudnBed may suspend or terminate accounts for material breaches of these Terms, including the warranties in Section 4 and the limits in Section 5.
12.3 We may amend these Terms with reasonable notice; continued use after the effective date constitutes acceptance where legally permitted.
13. Final provisions13.1 German law applies. For consumers, mandatory consumer-protection provisions of the country of habitual residence remain unaffected.
13.2 EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. BudnBed is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
13.3 Should individual provisions be invalid, the remainder stays in force.

Payment of the first month's rent (and any service fee) is made in full at booking. Funds are held by our payment partner Stripe and released per Section 6.5.
6.5 Release of funds to the host: The first month's rent is held and released to the host (a) as soon as the guest confirms successful move-in via the Platform or by email to hello@budnbed.com, or (b) automatically 48 hours after the agreed move-in time if no dispute has been reported under Section 8, whichever occurs first.
6.6 Subsequent months: Rent for months two and onward is paid directly between guest and host as agreed in their sublease agreement. BudnBed is not involved in, and assumes no responsibility for, these payments.
6.7 Deposits: Hosts may state a security deposit (Kaution) amount in their listing. This information is displayed for transparency only. The deposit is agreed, paid, held, and returned directly between host and guest in accordance with their sublease agreement and applicable law; it is never charged, held, or processed through the Platform, and no BudnBed fees apply to it. BudnBed does not verify deposit amounts and assumes no responsibility for the payment, safekeeping, or return of deposits.6.8 Partner listings. Certain operators, including student residences and co-living providers, manage bookings and payments in their own systems. These listings are marked "Partner listing" on the Platform. For partner listings: (a) the guest sends a booking request on the Platform, which the operator accepts or declines; (b) on acceptance, BudnBed shares the guest's full name and email address with the operator so that it can complete the booking, and no personal data is shared for declined requests; (c) the booking and the tenancy agreement are concluded directly between the guest and the operator, on the operator's own system; (d) all payments are made directly to the operator, and BudnBed does not receive, hold or process any payment for partner listings; (e) the operator's own booking, cancellation and refund terms apply; (f) Sections 6.1 to 6.5, 7 and 8 do not apply to partner listings.
7. Cancellation policy7.1 By the guest: a) Within 24 hours of booking confirmation, the guest may cancel and receive a full refund minus payment processing costs. This does not apply where move-in is less than 14 days after booking confirmation; in that case, the booking is binding from confirmation.b) After this window, no refund is made, unless the host agrees to the cancellation. If the host agrees, the rent is refunded to the guest minus payment processing costs, and the listing may be republished.c) No-show: no refund.d) The dispute process in Section 8 remains unaffected.
7.2 By the host: the guest receives a full refund of all amounts paid, minus payment processing costs. The guest's next service fee is waived. Repeated host cancellations lead to reduced visibility, suspension, or account termination.
7.3 Any service fee, where charged, is non-refundable except in cases under 7.2. Statutory rights, including the rules described in our Withdrawal Notice, remain unaffected.
8. Dispute process (move-in protection)8.1 If the accommodation materially deviates from the listing (materially different premises, uninhabitable condition, no access, wrong location), the guest must report this via the Platform or to hello@budnbed.com within 48 hours of the agreed move-in time, with photo or video evidence.
8.2 A timely report suspends the payout to the host. BudnBed reviews both parties' evidence and decides within 5 business days: full refund, partial refund, or release to the host.
8.3 Not covered: subjective dissatisfaction, minor deviations, or change of mind.
8.4 BudnBed's decision is final for the handling of the held amount on the Platform. The parties' statutory rights against each other remain unaffected.
9. Communication, reviews, conduct9.1 The Platform chat opens after a host accepts a guest's request. Users may not use the Platform to initiate off-platform bookings for stays arranged through the Platform.
9.2 After a completed stay, both parties may leave a review. Reviews must be truthful and relate to an actual stay. BudnBed may remove unlawful reviews.
9.3 Prohibited: unlawful listings; discrimination or harassment; surveillance devices in private areas; fraud or misrepresentation; use of the Platform by non-students as guests, or for non-residential purposes.
9.4 Notice-and-action: Illegal content or conduct can be reported to hello@budnbed.com. We review reports promptly and remove or block unlawful content. Contact point pursuant to the Digital Services Act: hello@budnbed.com.
10. Content licence10.1 Users retain all rights to their photos, videos, and texts. Users grant BudnBed the non-exclusive licence to host and display this content on the Platform for the operation of the service only. BudnBed does not use user content for advertising or marketing without separate, explicit consent obtained for the specific case.
11. Liability11.1 BudnBed is liable without limitation for intent and gross negligence, and for injury to life, body, or health.
11.2 For simple negligence, BudnBed is liable only for breach of essential contractual obligations (Kardinalpflichten), limited to the foreseeable, contract-typical damage.
11.3 BudnBed is not liable for the conduct of users, the accuracy of listings, the existence of hosts' permissions, the content or performance of rental or sublease agreements between users, payments made outside the Platform, or deposits.
12. Term, termination, changes12.1 Users may delete their account at any time. Booking and invoice records are retained as required by law (10 years, § 147 AO, § 257 HGB) in minimized form.
12.2 BudnBed may suspend or terminate accounts for material breaches of these Terms, including the warranties in Section 4 and the limits in Section 5.
12.3 We may amend these Terms with reasonable notice; continued use after the effective date constitutes acceptance where legally permitted.
13. Final provisions13.1 German law applies. For consumers, mandatory consumer-protection provisions of the country of habitual residence remain unaffected.

13.3 Should individual provisions be invalid, the remainder stays in force.

1. Who we are and what BudnBed is1.1 These Terms govern the use of BudnBed (budnbed.com, app.budnbed.com, the "Platform"), operated by BudnBed Technologies, operated by Mandeep Kumar, Fanningerstraße 45, 10365 Berlin, Germany ("BudnBed", "we"). Contact: hello@budnbed.com.
1.2 BudnBed is an online marketplace where verified students book residential accommodation. Hosts may be private individuals, students subletting, live-in hosts, residences, co-living operators or hostels.
1.3 BudnBed is an intermediary only. We are not a party to any agreement between users, not a landlord, not a property manager, and not a real-estate broker. The rental or sublease agreement is concluded exclusively between the host and the guest. Sample contract templates we provide are non-binding information, not legal advice.
2. Eligibility and accounts2.1 The Platform is available only to persons aged 18 or over. Guests must be enrolled students (or admitted incoming students) at a recognized higher-education institution. Hosts may be private individuals or businesses.
2.2 One account per person. Account credentials are personal and non-transferable.
2.3 Booking, listing, and messaging require completed verification (Section 3). Guests must complete identity and student-status verification. Hosts must complete identity verification, and business hosts must additionally verify their business.
3. Verification3.1 Before hosting or booking, users must complete verification by submitting a government-issued ID. Guests additionally submit proof of student status. Business hosts additionally submit company registration details. Processing is described in our Privacy Policy and requires the user's explicit consent, given before upload.
3.2 Verification documents are reviewed and deleted within 48 hours of the verification decision. Only the verification result is retained.
3.3 Verification confirms identity, and for guests student status, only. It is not a guarantee of any user's conduct, solvency, or the accuracy of their listings.
4. Listings and host warranties4.1 Hosts must describe their accommodation truthfully and completely, including whether sleeping arrangements are private or shared, using current photos and videos of the actual premises. Listings state, as declared by the host, which features are provided, for example whether city registration (Anmeldung) is possible, whether a written agreement is offered, and what is included. BudnBed displays these declarations as provided by the host and does not verify or guarantee them.
4.2 By publishing a listing, the host warrants that: (a) they hold all permissions required to let the accommodation, including, where the host is a tenant subletting, the landlord's permission under §§ 540, 553 BGB; (b) the offer complies with applicable housing law, including the Berlin Zweckentfremdungsverbot-Gesetz where applicable; (c) they will conclude a written rental or sublease agreement with the guest.
4.3 The host bears sole responsibility for the consequences of missing permissions or non-compliant offers. BudnBed may request evidence of permissions and may suspend or remove listings upon complaints or reasonable doubt.
4.4 Rental or sublease agreement: The host must provide the guest with the written agreement upon booking confirmation and at the latest by move-in. BudnBed provides a sample template for convenience; its use is recommended but the content of the agreement is solely the parties' responsibility.
5. Permitted stay durations5.1 The applicable stay rules depend on the type of accommodation listed.
5.2 Private residential listings (including rooms and flats let by private landlords, tenants subletting, and live-in hosts): the minimum bookable stay is 14 days and the maximum is 12 months. Stays of less than 30 days are limited to two (2) bookings per listing and per host within any calendar year. The Platform enforces these limits technically. These limits exist to keep short stays within the scope of lawful occasional residential letting, in particular under the Berlin Zweckentfremdungsverbot-Gesetz.
5.3 Commercially licensed accommodation (including hostels, student residences, co-living operators and other providers operating under a commercial accommodation permission or an applicable exemption): no minimum stay applies. By listing under this category, the host warrants that it holds the permissions required to offer short-term accommodation and that its offer complies with applicable law. BudnBed may request evidence of these permissions.5.4 Hosts must select the correct listing type. Selecting a commercial category without holding the required permissions is a material breach of these Terms.5.5 Circumventing duration or frequency limits (including via multiple accounts, off-platform arrangements initiated on the Platform, misdescribed dates, or misdeclared listing type) is prohibited and may lead to suspension or termination.
6. Booking, fees, and payments6.1 Bookings are concluded on the Platform: the guest sends a booking request; the host accepts; upon acceptance and payment of the service fee, a binding booking arises between host and guest.
6.2 Payment processing is provided by Stripe. BudnBed does not itself hold user funds. Hosts complete Stripe's payout onboarding (including identity verification by Stripe) and provide their tax identification number (Steuer-ID), or, for business hosts, their company registration details and tax identification as required by the Plattformen-Steuertransparenzgesetz.
6.3 Fees: Hosts pay no fee. Guests pay a one-time service fee of 8% of the first month's rent, minimum €25, charged at booking. All payment-processing costs are included in the service fee. BudnBed charges fees only on the first month's rent; no fees apply to subsequent months or deposits.
6.4 Payment flow: Listings can be booked no earlier than 60 days before move-in. Upon the host's acceptance, the guest has 24 hours to complete payment; otherwise the booking request expires.
